Confluence Technologies Inc. and its subsidiaries (collectively “Confluence”) is committed to respecting the privacy rights of individuals.

References to you, your, and yourself in this privacy notice are to either you as an individual or any organization that you work for.

For the purposes of data protection Confluence Technologies Inc. will be the controller of any of your personal information. If any other part of our group is the controller of your personal information you will be notified at the time we collect your personal information. The Personal Information we collect

• Other information provided as a prospective employee during the recruitment process: including education and qualifications.
• Advisors appointed by you: including lawyers and financial advisors.
• Business information: including organization details (e.g. place of work, job title, organization contacts information), billing, payment or banking details.
• Responses to surveys, competitions and promotions: including records of any surveys you respond to or your entry into any competition or promotion we run.
• Creditworthiness: We may undertake investigations into your creditworthiness in order to establish whether to enter into or continue a business relationship with you or the organization you work for.
• Details of your performance: when working with or for us or in relation to any project or work we are engaged in.
• How you use our website: including the pages you look at and how you use them, usernames and passwords.
• Videos, photographs and audio recordings: which you or other people take and provide to us or we take ourselves.
• CCTV images: if you visit any of our premises, some areas may be covered by CCTV or similar system.
• Your usage of the IT systems we make available to visitors to our premises: for example our guest internet and Wi-Fi facilities.

• Technical information: including the Internet Protocol (IP) address used to connect your computer to the Internet, source domain names, browser type and version, time zone setting, length of time spent, and operating system and platform.
• Information about your visit: even if you have not created an account or logged in, including the full Uniform Resource Locators (URL), specific web pages, clickstream to, through and from our site including date and time, products and services you viewed or searched for, page response times, download errors, length of visits to certain pages, and any phone number used to call our customer service number.

Special Categories of Personal Information and Criminal Convictions

We may collect, store and use the following “special categories” of more sensitive personal information regarding you:

• information about your race or ethnicity, religious beliefs, sexual orientation and political opinions;
• information about your trade union memberships;
• information about your health, including any medical condition, health and sickness records, medical records and health professional information; and
• biometric information about you, for example your height and weight.

If we do collect any special category personal information, we do not currently rely on consent as a basis for processing special category personal information.

There are limited situations in which we may collect, store and use any criminal records information in relation to you. If we do collect any criminal records information, we will do so on the basis of legal obligations or based on your explicit consent.

Sources we collect your Personal Information from

We will collect personal information from a number of sources:

• Directly from you: when you complete forms we provide to you, when we engage with you by phone, email or you communicate with us directly in some other way, or when you make a complaint or claim.
• Our website: provides us with information about how you use it and the devices that you use to connect to our website.
• Our providers of background information: which may include credit reference agencies, AML check provider, Companies House, LinkedIn and other work related web platforms, former employers, referees and employment agencies.
• Your employer or the organization you work for: they may provide us with your name, position contact details and background information about you.
• Our professional advisors: such as lawyers, accountants, financial advisors, consultants and other advisors.
• Your professional advisors: such as lawyers, accountants, financial advisors, consultants and other advisors.
• The Government, local authorities or relevant regulators: to assist with investigations, for example the Information Commissioner's Office or applications to the local authority.

We and third parties we engage may combine information we collect from you over time and across our Website with information obtained from other sources. This helps us improve the information’s overall accuracy and completeness, and also helps us better tailor our interactions with you.

We will also collect additional personal information throughout the period of our relationship with you.

If you are providing us with details about other individuals they have a right to know and to be aware of what personal information we hold about them, how we collect it and how we use and may share that information. Please share this privacy notice with those of them whom you feel are sufficiently mature to understand it. If you are providing information regarding other individuals to us, it is your responsibility that the personal information you communicate to us is up-to-date and accurate.

How we use your Personal Information

The table below describes the main purposes for which we process your personal information, the categories of your personal information involved and our lawful basis for being able to do this. Which will apply will depend upon the nature of your relationship and interactions with us.

If you do not provide us with the requested personal information we may not be able to properly perform our contract with you or the organization you represent or comply with legal obligations and we may have to terminate our relationship. For other personal information you may not be under an obligation to provide it to us, but if you do not provide it then we may not be able to properly perform our arrangements with you or the organization you represent.

Where you have given us your consent to use your personal information in a particular manner, you have the right to withdraw this consent at any time, which you may do by contacting us as described in the “Contacting us” section below. We will generally only ask for your consent for direct marketing.

Please note however that the withdrawal of your consent will not affect any use of the data made before you withdrew your consent and we may still be entitled to hold and process the relevant personal information to the extent that we process that information on a basis other than your consent. Withdrawing consent may also have the same effects as not providing the information in the first place, for example we may no longer be able to provide marketing information to you.

We may anonymize and aggregate any of the personal information we hold (so that it does not directly identify you and ceases to be your personal information). We may use anonymized and aggregated information for purposes that include testing our IT systems, research, data analysis, improving our site and developing new products and services.

How we share your Personal Information

We may share your personal Information with the following third parties, in some cases located outside of the European Economic Area (the “EEA”):

• Purchasers of our business: buyers or perspective buyers to whom we sell or negotiate to sell our business.
• Law enforcement officials, government authorities, or other third parties: as necessary to comply with legal process or meet national security requirements; protect the rights, property, or safety of Confluence, its business partners, you, or others; or as otherwise required by applicable law.
• Competent authorities: if we believe disclosure is in accordance with, or is otherwise required by or desirable with reference to, any applicable law, regulation or legal process.
• In aggregated, anonymized, and/or de-identified form: that cannot be used to identify you.

We do not disclose personal information to anyone else except as set out above unless we have your consent or we are legally obliged to do so. We do not sell, rent or trade your data.

Direct Marketing

For direct marketing purposes, we may share your personal information with StatPro and StatPro’s affiliates and subsidiaries.

From time to time, we or StatPro may contact you by email, post or SMS with information about products or services we believe you may be interested in.

You can then let us know at any time that you do not wish to receive marketing messages by sending an email to us at confluence_privacy@confluence.com. You can also unsubscribe from our marketing by clicking on the unsubscribe link in any marketing messages we send to you.

The personal information we collect about you is not transferred to or stored in countries outside of the UK or European Union except as set out in this section.

As a global organization with legal entities and business processes in operation across borders we may transfer your personal information to Confluence in the United States of America, to any Confluence subsidiary worldwide, or to third parties and business partners as described above that are located in various countries around the world. By using our websites or providing any personal information to us, where applicable law permits, you are informed of the transfer, processing, and storage of such information outside of your country of residence where data protection standards may be different.

Retention of Personal Information

We will retain your personal information as needed to fulfill the purposes for which it is collected. We will retain and use your Personal Information as necessary to comply with our business requirements, legal obligations, resolve disputes, protect our assets, and enforce our agreements. We have set out below the main retention periods which will apply:

• For individual contacts at customers this will be for as long as we continue to have a relationship with that customer or supplier and then for a period of 10 years afterwards.
• For individual contacts at suppliers this will be for as long as we continue to have a relationship with that customer or supplier and then for a period of 8 years afterwards.
• For individuals making complaints and/or claims it will generally be a period of 10 years after resolution of the relevant complaint and/or claim.
• For prospective employees (who do not become employees) the longer of 2 years form the date of the record’s creation or 2 years from the date of the decision not to hire.

It is important to ensure that the personal information we hold about you is accurate and up-to-date, and you should let us know if anything changes, for example if you move position or work for a different organization or change your phone number or email address you can contact us by using the details set out below.

 Your Rights

You have the right to be informed about how your personal information is being used, access, obtain a paper or electronic copy, review, correct and update all your personal information stored by us to confirm its accuracy. You may request that certain of your personal information be deleted from our files. You may have the right to restrict or object to the processing of your personal information. Children’s Privacy

Confluence encourages parents and guardians to take an active role in their children's online activities. Confluence does not sell or offer its services and products to children. As such, our sites are designed for adult user interaction. We do not intentionally collect personally identifiable information from children under the age of 18. If you are a parent or legal guardian of a minor under the age of 18 and believe that the minor has disclosed personal information to us, please contact us.

Updates

We may update this privacy notice from time to time.
